General terms of sale

1. Seller and subject of the contract

1.1 PurplePrice is not a business: the website purpleprice.com (the "Site") is a showcase through which its owner ("PurplePrice" or the "Seller"), acting as a private individual, sells design and furniture items from their own personal collection. Sales are therefore between private individuals and are not sales by a trader to a consumer: the provisions of the Italian Consumer Code (Legislative Decree no. 206 of 6 September 2005) that apply to traders do not apply; the rules of the Italian Civil Code on sales (Article 1470 et seq.) apply instead.

1.2 This contract ("Contract") concerns the distance sale, through the Site, of the items chosen by the buyer (the "Customer"). The Contract is concluded as described in Article 3.

1.3 These terms of sale ("Terms") may be amended by the Seller. Changes take effect from the date they are published on the Site and apply to orders placed from that date.

2. Prices

The prices shown on the Site are final prices: as these are sales between private individuals, no VAT is charged and no invoice is issued. Shipping costs are shown on the Site and summarised to the Customer before the order is confirmed.

3. Ordering and payment

3.1 After placing an order through the Site, the Customer receives a summary e-mail. The order is deemed accepted unless the Seller notifies otherwise by e-mail within 3 (three) calendar days of the summary e-mail.

3.2 The Customer can pay by: (a) PayPal, including by credit or debit card; (b) advance bank transfer, with the bank details sent by e-mail after the order. For bank transfers, the item is shipped once payment has been received.

4. Availability

The items for sale are one-offs or available in limited quantities. If an item is no longer available, the Seller informs the Customer by e-mail and refunds in full any amount already paid.

5. Condition of the items

The items are the Seller's personal property and may be new, unused or used. The condition of each item, including any signs of use or defects, is stated in the description and shown in the photos on the product page. Before buying, the Customer can ask for more information or photos by writing to info@purpleprice.com.

6. Shipping and delivery

6.1 The Seller ships the items, carefully packed, to the address given by the Customer within 30 (thirty) days of the conclusion of the Contract.

6.2 On delivery, the Customer should check the packaging and immediately report any transport damage to the courier and to the Seller.

7. Warranty

7.1 The Seller guarantees that the items match the description published on the Site. The warranty against defects provided by the Italian Civil Code (Article 1490 et seq.) applies: defects not stated in the description must be reported in writing to info@purpleprice.com within 8 (eight) days of their discovery and, in any case, within one year of delivery.

7.2 The warranty does not cover signs of use and defects stated in the description or visible in the photos, nor damage caused by improper use after delivery.

8. Voluntary returns

8.1 Although not required by law, the Seller accepts returns within 30 (thirty) days of receipt, without the Customer having to give a reason. The Customer must notify the Seller by e-mail at info@purpleprice.com and send the item to the address provided, within the same period.

8.2 Return shipping costs are borne by the Customer. Within 30 days of receiving the returned item, the Seller refunds the full price paid if the item is in the same condition as when it was shipped, or the part of the price corresponding to its value if it has been damaged or used in a way that reduces its value.

9. Processing and confidentiality of personal data

9.1 The personal data provided by the Customer is processed by the Seller, using electronic and manual means, in compliance with the applicable data protection legislation.

Purposes of processing

The data collected is processed for the following purposes:

• a. registration on the Site;
• b. conclusion and performance of sales;
• c. shipping of the items and customer support;
• d. sending commercial and promotional information (newsletter), only with the Customer's consent;
• e. statistical analysis, in aggregate form, to check that the services work properly and are appreciated.

Providing data is mandatory to conclude the purchase contract and optional in all other cases. If the necessary data is not provided, the order cannot be fulfilled.

Recipients of the data

The data may be disclosed, for the stated purposes only, to:

• parties entitled to receive it by law or regulation (for example public offices and authorities);
• parties needed to provide the requested services (for example couriers, PayPal, banks);
• technical service providers used by the Seller to run the Site (for example hosting and e-mail).

Data retention

The data is not used for purposes other than those stated and is kept for as long as needed to achieve them. After that, it is deleted or anonymised. Data relating to purchases and services is kept for the period required by law.

Rights of the data subject

The Customer may exercise at any time the rights provided by data protection legislation, including the right to access, correct, update and delete their data and the right to object to processing, by writing to info@purpleprice.com.

Data controller

The data controller is the owner of the Site, who can be contacted at info@purpleprice.com.

10. Governing law and jurisdiction

The Contract is governed by Italian law. Disputes fall under the jurisdiction of the court determined according to the Italian Code of Civil Procedure; if the Customer resides or is domiciled abroad, the court of Milan has jurisdiction.

11. Cookies

The Site uses the following cookies:

• Technical cookies (always active, no consent required): the session cookie, needed for the cart, the customer area and form security; a preference cookie that remembers the flag chosen for English.
• Statistics cookies – Google Analytics (only with your consent): they collect aggregate information about visits to the Site. They are provided by Google Ireland Ltd.; data may also be transferred outside the European Union.
• Consent management – Google: the cookie message is provided by Google through AdSense and stores the choice you make.

Until you give your consent, Google Analytics does not store cookies on your device. You can change or withdraw your consent at any time with the "Cookie preferences" link at the bottom of every page, or by deleting cookies in your browser settings.
